These terms and conditions apply to all our services made available online, through any mobile device, by phone or by email. By accessing and using our website or any of our applications through whatever platform, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including our Privacy Policy).
As a condition of your use of this platform you warrant that (a) you are at least 18 years of age; (b) you possess the legal authority to enter into a binding legal obligation. Have Fun Sailing IKE reserves the right to deny access to anyone to this platform and to the services we offer.
Have Fun Sailing IKE provide an online platform where yacht provider can advertise their fleet and you, the ‘Charterer’, can rent a yacht. By making a rental through this website, you enter into a direct (legally binding) contractual relationship with the yacht provider. We act solely as an intermediary between you, the ‘Charterer’, and the yacht provider, transmitting the details of your rental to the relevant yacht provider and sending you a booking confirmation email on behalf of the yacht provider.
When offering our services, the information that we show is based on the information provided to us by the yacht providers. They are given access to an online system through which they are fully responsible for updating the rental price, availability and other information which is displayed on our platform. Although we will use reasonable resources in performing our services, we cannot guarantee that all information is accurate, complete or correct, nor can we be held responsible for any errors (including typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our platform or otherwise), inaccurate, misleading or untrue information or non delivery of information. Each yacht provider remains responsible at all times for the accuracy, completeness and correctness of the information (including the rental price and availability) displayed on our platform.
Have Fun Sailing collect several data from the website, during the process of booking and by means of a contact form or by the newsletter. Please read our Privacy Policy. We respect your privacy. At any time, you can refuse to store your data by email to info@havefunsailing.gr
Yacht providers ask for the rental price to be paid (fully or partly) to guarantee the rentals. Payment conditions depend on the yacht provider, so please be sure to understand and agree before your booking. You will be asked to guarantee your rental during the reservation process. Prices shown are per yacht for your entire reservation, including VAT and all other taxes, unless stated differently. You should check the rental details thoroughly for any such conditions with all the inclusions and exclusions in your yacht rental prior to making your reservation. Have Fun Sailing IKE will accept the Charterer's payment on behalf of the yacht provider and forward it to the yacht provider or owner directly.
By making a reservation on our platform you accept and agree to the relevant cancellation policy of that yacht provider, and to any additional terms and conditions of the yacht provider that may apply to your rental, including services or/and products offered by the yacht provider. The delivery terms and conditions of a yacht provider can be obtained from the relevant yacht provider. Please note that some rentals are not eligible for cancellation or change. In that case, we recommend you be sure before booking and/or applying for additional trip cancellation insurance at your convenience. We recommend that you read the cancellation and payment policy of the rental carefully prior to making your rental and remember to make further payments on time. You have to take note that a rental may be cancelled (without prior notice) if the relevant (remaining) rental amount cannot be collected on the relevant payment date in accordance with the relevant payment policy of the rental. Late payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds are your own responsibility and you shall not be entitled to any refund of the prepaid amount unless the yacht provider agrees otherwise.
By completing a reservation, subscribing to our newsletter or by our contact form, you agree to receive marketing information related to possible promotions and offers that may be of interest to you. After your trip, we may send you also an email asking you for a review and opinion to improve our quality service, which may be uploaded on our website for the purpose of informing future Charterers. We reserve the right to adjust, refuse or remove reviews at our sole discretion. You can refuse at any time about your marketing consent by sending an email to info@havefunsailing.gr
Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email or contract (whether for one event or series of connected events). However and to the extent permitted by law, neither we nor any of our directors, employees, representatives, subsidiaries, affiliated companies, or others involved in managing the platform and its contents shall be liable for (a) any direct, indirect, consequential or punitive loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation (b) any inaccuracy relating to the (descriptive) information (including rental price, availability) of the listings as made available on our platform, (c) the services or products offered by the yacht provider or other business partners, (d) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our platform, or (e) any injury, death, property damage, or other (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the service provider or any of our other business partners (including any of their employees, directors, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the platform, including any cancellation, overbooking, strike, force majeure or any other event beyond our control.
These pages, the content and the infrastructure and the online yacht reservation service provided through the platform are operated and owned by Have Fun Sailing IKE and are provided for your personal, non-commercial use, subject to the terms and conditions set out below. You are not entitled to copy, scrape, publish, promote, utilise, or otherwise use the content (including any translations and reviews) or our brand without our written permission. Any unlawful use or behaviour will constitute a material infringement of our intellectual property rights.
We keep the right to change our Terms and Conditions at any time. Changes will be posted on those websites and we recommend that you check our Terms and Conditions regularly. To the extent permitted by law, these terms and conditions and the provision of our services shall be governed by and construed in accordance with Greek law and any dispute arising out of these general terms and conditions and our services shall exclusively be submitted to the competent courts in Greece.
